1. Acceptance of Terms

By accessing or using the website smartaura.ca (the "Site") and/or engaging SmartAura Network Solutions ("we," "us," or "our") for smart home installation and automation services (the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Site or Services.

2. Services Description

SmartAura Network Solutions provides consultation, design, installation, and maintenance services for home automation systems, including but not limited to smart lighting, security, climate control, networking, and entertainment systems.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

3. Quotations and Payments

  • Quotes: All price quotations provided are estimates based on the information available at the time. Final pricing is subject to an on-site assessment and the specific equipment selected. Quotes are valid for 30 days unless otherwise stated.
  • Deposits: A deposit may be required to schedule installation services or order specific hardware. This deposit is non-refundable once equipment has been ordered.
  • Payment Terms: Full payment is due upon completion of the installation unless otherwise agreed in writing. We accept major credit cards, bank transfers, and other approved payment methods.
  • Late Payments: Overdue payments may incur interest charges at a rate of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is lower.

4. Installation and Access

By booking our Services, you grant SmartAura Network Solutions and our authorized personnel access to your property at the agreed-upon times to perform the installation. You represent that you have the legal authority to grant such access and to authorize the installation of equipment on the property.

You agree to provide a safe working environment for our technicians. If specific preparations (e.g., clearing furniture, ensuring Wi-Fi access) are required, you agree to complete these prior to our arrival.

5. Limited Warranty and Liability

Workmanship Warranty: We warrant our installation workmanship for a period of one (1) year from the date of completion. This warranty covers defects arising solely from improper installation.

Equipment Warranty: Hardware and equipment installed by us are subject to the original manufacturer's warranty. We will assist you in facilitating warranty claims with the manufacturer where possible, but we do not independently warrant the hardware.

Limitation of Liability: To the fullest extent permitted by law, SmartAura Network Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, our Site or Services.

6. Intellectual Property

The Site and its original content, features, and functionality are owned by SmartAura Network Solutions and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You agree not to reproduce, modify, distribute, or create derivative works based on our content without our express written consent.

7. User Conduct

You agree not to use the Site or Services to:

  • Violate any applicable national or international law or regulation.
  • Infringe upon the rights of others, including intellectual property rights.
  • Transmit any unsolicited advertising, promotional materials, or "spam."
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Services shall be resolved in the courts located in Ontario.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Site or Services after those revisions become effective, you agree to be bound by the revised terms.
